TERM & CONDITION

APPLICABILITY: DEFINITIONS

This User Agreement, along with the Terms of Service (collectively, the “User Agreement”), forms the terms and conditions for the use of services and products of BreakBag Holidays Private Limited (“BreakBag”).

Any person (“User”) who inquiries about or purchases any products or services of BreakBag through its websites, mobile applications, salespersons, offices, call centers, branch offices, franchisees, agents, etc. (all the aforementioned platforms collectively referred to as “Sales Channels”) agrees to be governed by this User Agreement. The websites and the mobile applications of BreakBag are collectively referred to as the “Website.”

Both User and BreakBag are individually referred to as “Party” and collectively referred to as “Parties” to the User Agreement.

“Terms of Service” available on BreakBag’s website details out terms & conditions applicable to various services or products facilitated by BreakBag. The User should refer to the relevant Terms of Service applicable for the given product or service as booked by the User. Such Terms of Service are binding on the User.

“Independent Contractors” refer to individuals or organizations that have been selected by the User to render services such as hoteliers or hotel owners, airlines or shipping companies or railway ferryboat owners, coach owners, or any other person or organization.

“Outbound Tour” is a tour operated by BreakBag outside of the country and includes various types of tours such as brochure tours, special tours, packages, cruises, sightseeing, carnival, cosmos, star cruise, etc.

“Tour Cost” means the total booking cost of all services booked by the User for their outbound tour.

“Booking Fees” refer to non-refundable fees or token money deposited by the User at the time of booking.

“Brochure” is a document that contains details about the itinerary and activities on an outbound tour.

“Infant” means a person below the age of 2 years, and a child means a person above the age of 2 years and below the age of 12 years.

ROLE OF BREAKBAG AND LIMITATION OF LIABILITY: OUTBOUND AND DOMESTIC TOURS: DEFINITIONS AND LIMITATION OF LIABILITY

BreakBag is a facilitator and does not control or operate any airline, shipping company, coach, hotel, transport vehicles, restaurant, kitchen caravan, or any other facility or service mentioned in the Brochure. Therefore, BreakBag shall not be responsible for any delay, improper service, or standard of service provided by any Independent Contractor or service provider, or for any injury, death, loss, or damage caused by the act or default of any hotel, airline, shipping company, cruise, coach owner, or tour operator who are BreakBag’s independent contractors.

BreakBag shall not be responsible for any act or actions of co-travellers or co-passengers which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided on the outbound tour.

As a facilitator, BreakBag shall not be liable for personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage, or any kind of theft caused to the User or any person traveling with them. BreakBag shall also not be liable for any act, omission, default of any travel agent or third party, or any other person or servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility, or service for the User or for any person traveling with them. Additionally, BreakBag shall not be liable for the temporary or permanent loss of or damage to baggage or personal belongings caused by any person, including willful negligence on the part of any person.

BreakBag shall not be liable for any delay made in the delivery of the service by the concerned service providers or failure on the part of the airline or hotel to accommodate passengers despite having confirmed tickets or booking for any reason whatsoever, including overbooking or change of route. Moreover, BreakBag shall not be liable for any claims of any dispute with the tour manager, any claim arising due to delay at the airport, or any damages caused to the User due to reasons beyond the control of BreakBag.

In no event shall the entire liability of BreakBag for any claims directly and indirectly arising out of the tour exceed the total booking amount paid by the User.

However, there can be exceptional circumstances where service operators like airlines, hotels, transportation providers, or concerns may be unable to honor confirmed bookings due to various reasons such as climatic conditions, labour unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations, etc. If BreakBag is informed in advance of such situations where dishonour of bookings may happen, it will make its best efforts

BREAKBAG TRAVEL BROCHURE

Please note that all information provided in this brochure is accurate as of the publication date. However, BreakBag reserves the right to modify any information contained in the brochure before or after booking an outbound tour due to unforeseen circumstances beyond our control.

If we become aware of any changes before the departure of an outbound tour, we will make every effort to notify the user of such changes in advance. If changes are discovered after the departure of the tour, our tour manager or local representative will inform the user about the change.

The prices quoted in this brochure are based on the prevailing rates at the time of printing. BreakBag reserves the right to modify prices in case of currency fluctuations, changes in gross rates of exchange, fuel costs, high season charges levied by suppliers, and airline or rail charges. Any price increases must be paid in full by the user before departure.

Specific terms and conditions related to each outbound tour are mentioned on our website, email communication, and confirmed booking vouchers. These terms and conditions are an integral part of the BreakBag User Agreement and Terms of Service and should be read in conjunction with each other.

BreakBag is not liable for any claims made by the user regarding changes in the brochure due to reasons beyond our control.

MEALS AND SPECIAL REQUESTS

Menus for meals during outbound tours are predetermined and specified in the brochure. BreakBag cannot accommodate requests for special meals or diets, except to the extent mentioned in the brochure. We reserve the right to change the menu if necessary. If the user is unable to avail the meals specified in the menu for any reason, no claim can be made against BreakBag.

Hotels around the world serve breakfast at different times as specified in the confirmed booking voucher, and breakfast must be consumed when served. Hotels do not pack or deliver breakfast to rooms. If the user misses breakfast for any reason, no claim can be made against BreakBag.

BreakBag may consider requests for special meals or room allocations, subject to such requests being honoured by the respective service providers. We will do everything possible to ensure that special requests are honoured. However, if the service providers cannot fulfil such requests, BreakBag will not be held liable. Any additional charges for special meals or requests must be borne by the user.

If the user purchases any special meals and fails to avail them for any reason, BreakBag will not be liable, and the user must bear the additional charges. If BreakBag is responsible for the user’s inability to avail meals, we will only be liable for the proportionate amount the user paid for the meal while booking the outbound tour.

 

HOTELS IN OUTBOUND TOUR

BreakBag takes utmost care in selecting the hotels that are part of its Outbound Tour. Our internal assessment process ensures that the hotels we select are amongst the best in their respective categories. We strive to provide our users with detailed information about the hotels well in advance, through the proposed itinerary. However, we reserve the right to change hotels before booking, based on availability or for reasons beyond our control.

Once a user selects a particular hotel category or star rating, we will not entertain any claims or disputes related to the hotel’s star rating or type.

BreakBag cannot be held liable for any inconvenience or discomfort caused to users due to insufficient services provided by the hotel. We act as a facilitator between the user and the hotel and, therefore, will not be held responsible for any inadequate services provided by the hotel.

Users will be responsible for any damages caused to the property of the hotel by them or their accompanying guests in any manner whatsoever. The extent and amount of the damage will be determined by the hotel concerned. BreakBag will not interfere in any way.

Requests for a change of hotel will not be entertained once the booking is confirmed. If the user decides to upgrade or change the hotel independently, they agree to bear the charges incurred for the change and will not be entitled to claim it from BreakBag.

Users are responsible for their baggage and valuables. BreakBag will not be held liable for any loss of baggage or theft of user’s articles during their stay in the hotels or at any time during the tour. 

BREAKBAG ITINERARY

At BreakBag, we strive to provide our customers with a seamless travel experience. Before booking, we will provide you with a proposed itinerary that is subject to changes. However, the confirmed booking details and hotel vouchers sent to you after payment of the entire booking amount shall be considered final.

Please note that the Outbound Tour price is subject to increase without any prior notice if the rate substantially changes prior to departure. In such a case, you will be required to pay the incremental tour cost before the departure.

The days and nights of the itinerary are decided based on the availability of hotels and airlines. Therefore, no claims regarding full utilization of the last day or inclusion in the tour shall be valid.

At BreakBag, we take all reasonable steps to ensure that the itinerary is as per your convenience and comfort. In the event of a change in the itinerary, we will inform you before your departure. Moreover, if there is any change beyond our control in the itinerary of your outbound tour post-departure, we shall inform you accordingly. However, we shall not be held responsible for any loss that you might suffer due to such a change.

Please note that we reserve the right to claim any additional expenses on account of delays or changes in the itinerary caused by any reason whatsoever. We also reserve the right to amend, alter, vary or withdraw any particular departure, excursion, or substitute a hotel of similar category or any other aspect of the itinerary, if deemed advisable or necessary.

We request you not to request any changes in the itinerary after booking, as such changes might disarray the entire tour. However, we may, in our sole discretion and subject to availability, provide changes in the itinerary made at your request. You agree to pay the additional cost incurred due to such changes or cancellation.

COACH AND SEATING

At BreakBag, we use coaches for transfer purposes, including local sightseeing during Outbound Tours. There are no seat numbers allocated, and you shall follow the instructions of the Tour Manager in this regard.

We recommend that you do not leave any valuable personal belongings behind while disembarking or leaving the coach. We shall not be held responsible or liable in case of any loss of such items from the coach. Moreover, any damage caused to the coach during travel as a consequence of your actions shall be payable by you, and we would not be liable for the same.

Please note that the drivers of the coaches are bound by specific rules like maximum driving hours within a day/during a week, rest period per day/week, etc. You will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In the event that any of the sightseeing schedules is missed due to delays caused by you, the cost of the same will not be refunded to you under any circumstances.

In the event of a breakdown of any coach or any vehicle arranged for transportation, we will provide an alternative within a reasonable time. We shall not be liable for any delays that occurred due to such breakdown or traffic jam or for any reasons causing delay in the provision of alternative coach or vehicle.

CURRENCY AND TRAVELER’S CHEQUES

When traveling abroad, it’s important to have a plan for managing your money. At BreakBag, we recommend that travellers carry a mix of local currency, traveller’s cheques, or a travel currency card.

Traveller’s cheques are a secure way to carry money. They can be easily cashed for a small service fee charged by the bank and replaced if lost or stolen, as long as you have the traveller’s cheque numbers and the counterfoil. Alternatively, travellers can opt for a travel currency card, which is the safest way to carry foreign currency and offers 24/7 access to cash at relevant ATMs.

ACCOMMODATION FOR CHILDREN BELOW 12 YEARS OF AGE

Please note that if a child under 12 years of age is booked on an outbound BreakBag tour without paying for a separate bed, the hotel will not provide a separate bed. Thank you for your understanding.

AIRLINES:

TERMS OF THE AIRLINES

Breakbag Holidays Private Limited (hereinafter referred to as “Breakbag”) acts as a facilitator for users to book flight tickets through various airlines. The terms and conditions for flight tickets, including but not limited to cancellation and refund policies, are subject to the individual policies of the respective airlines.

Users are advised to carefully read and understand the airline policies before booking the flight ticket. By booking a flight ticket through Breakbag, the user agrees to abide by the terms and conditions of the respective airline.

Airlines may reserve the right to reschedule flight timings, change routes, or cancel flights at their discretion without prior notice to Breakbag. In such cases, Breakbag shall not be held liable for any direct or incidental loss that may be incurred by the user.

Different tickets on the same airline may carry varying restrictions and inclusions such as baggage allowances and services, and the user is advised to review such terms before booking.

The baggage allowance for a given fare is as per the airline’s policies, and Breakbag has no role to play in this regard. Some fares may be “hand baggage fares,” which do not include check-in baggage. In such cases, the user will be required to pay separately for check-in baggage, and the prices may vary from airline to airline.

TRAVEL DOCUMENTS

Users must ensure they possess valid travel documents such as identity proof, passport, visa, etc., to undertake the travel. Breakbag shall not be held liable for any inability to travel due to the user not carrying valid travel documents.

The information provided by Breakbag regarding travel documents is only advisory in nature and cannot be considered conclusive. Users must ensure they check the requirements of travel with the respective airlines and jurisdictions the user may transit through or visit.

CHECK-IN TERMS

Users are advised to check with the airlines directly regarding check-in timings. Generally, check-in begins 2 hours before departure for domestic flights and 3 hours before departure for international flights.

Users must carry valid identification proofs, passport, and age proofs as may be required to prove the identity, nationality, and age of the passengers traveling on a ticket, including infants.

USE OF FLIGHT SEGMENTS

In the event that the user does not embark on the onward journey, the airline may automatically cancel the entire PNR pertaining to that booking. In such a scenario, Breakbag has no control over the process and will not be obligated to provide alternate bookings to the user. The cancellation penalty, in this case, shall be as per the applicable airline rules.

CHANGES TO EXISTING BOOKING

Any changes made to an existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by Breakbag.

The user shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline’s policy and fare class, charges for changes or modifications to existing bookings may vary.

REFUND

Refunds for cancelled flight tickets shall be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to Breakbag receiving the same from the airlines. However, the convenience fee paid to Breakbag at the time of booking is a non-refundable fee.

Users must inform Breakbag of any cancellations made directly with the airline to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank, etc. The refund shall be processed after deducting the Breakbag service fee, which is independent of the convenience fee mentioned above.

TOUR & TRANSFER:

PAYMENT FOR YOUR TOUR

You are required to make the payment as per the payment schedule communicated to you at the time of booking. This information will be available on the brochure, email or any other documented communication.

The payment can be made online or by way of DD/cheque as specified by us. We accept payment in INR as well as any other foreign exchange/currency, as we rely on various outbound service providers and independent contractors for planning your tour.

In case any cheque towards the payment is dishonoured, we reserve the right to cancel your booking without any liability and take necessary legal action.

Please note that final documents and airline tickets will be shared with you only after you have made the balance payment to us. If you make a cash payment of Rs. 25,000/- or above, we will require a copy of your PAN Card.

For calculating the cost of your tour or refund, we will consider the foreign exchange components of the outbound tour at the prevailing day’s rate of exchange. Any increase or decrease in the rate of exchange may cause the cost of your tour or refund amount to change, and you will be liable to bear any such changes.

We are not obligated to provide a break-up of the invoice for each service included in the package.

FORCE MAJEURE

There may be exceptional circumstances where BreakBag and/or its Service Providers may be unable to honour confirmed bookings due to various reasons, such as act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, route and flight cancellations, or any other reason beyond the control of BreakBag. If BreakBag has prior knowledge of any such situations where dishonour of bookings may happen, it will make its best efforts to provide similar alternatives to the User or refund the booking amount after deducting applicable service charges, if supported and refunded by the respective service operators. The User acknowledges and agrees that BreakBag is merely a facilitator of the services and products booked and cannot be held responsible for any such Force Majeure circumstance. The User must contact the Service Provider directly for any further resolutions and refunds.

The User agrees that in the event of non-confirmation of booking due to any technical reasons, such as network downtime, disconnection with third-party platforms such as payment gateways, banks, or any other similar failures, BreakBag’s obligation shall be limited to refunding the booking amount, if any, received from the customer. Such refund shall completely discharge BreakBag from all liabilities with respect to that transaction. Any additional liabilities, if any, shall be borne by the User.

In no event shall BreakBag be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.

REFUNDS

We act as a facilitator, and any refund for services that are not delivered by the service provider or independent contractors or for any reason for which you are entitled to a refund is subject to us receiving the amount from the respective service provider. You acknowledge that we will not be held liable for any delay in refund or non-refund of the amount from the service provider or independent contractors. In such events, you will have to directly approach the service provider for any claims.

In case you make any changes in your accommodation while on the outbound tour, we will not refund or pay any compensation. You will also be liable to pay any additional sum required to be paid due to the changes made in the accommodation.

In case there is any delay in the refund beyond the specified period, our liability will be limited to the refund of the said amount with interest calculated at the applicable bank rate till the date of refund.

CANCELLATION CHARGES

If the Outbound Tour is cancelled for any reason what-so-ever, including cases of visa rejection or voluntary cancellation by the User the cancellation charges as mentioned in the brochure or the itinerary will apply. In the absence of any such information, the following cancellation charges will apply: Time period in which the cancellation is made Charges 45 days or more, prior to departure Booking fees Between 44 and 31 days of departure 25% of Tour Cost Between 30 and 15 days of departure 50% of Tour Cost Between 14 and 8 days of departure 75% of Tour Cost Within 7days prior to date of departure, or no-show for any reason what-so-ever 100% of Tour Cost

COVID-19 RELATED TERMS & CONDITIONS:

User agrees that due to the recent outbreak of COVID-19 pandemic, which has been declared as a national disaster by the Government of India, there may be instances, where the end service provider either cancels the booking or refuses to provide the services, as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the User:

Exhibiting any symptoms associated with COVID-19.

Refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms, etc.

Suffering from any ailment making the User vulnerable to the virus.

Posing a threat to the health and safety of others.

In such cases, Breakbag will assume no liability for the refusal of service by the end service provider. The User also agrees that refund, if any, for such bookings will be processed by Breakbag to the User subject to receipt of the same from the end service provider.

User further understands that due to the outbreak of COVID-19, the Central Government through its ministries, State Governments, and statutory bodies have/may come up with detailed set of guidelines or standard operating procedure (SOP) that a traveller will have to follow in order to undertake the travel.

The User agrees to abide by all such guidelines/SOP while undertaking any travel. Failure to abide by such detailed set of guidelines/SOP may lead to a situation where the service provider or any person authorized by the Central Government, State Government, or statutory body may disallow the User to undertake the travel. In such circumstances, Breakbag will not be held liable for such refusal to travel, and refund, if any, shall be strictly as per the terms of the service provider.

User understands that the Central Government, State Governments, and various other bodies may mandate downloading of Arogya Setu App or submitting a self-declaration form prior to entering a transit point like airport, railway station, etc., or at the time of checking-in for a flight, into a hotel, etc. Accordingly, the User must ensure downloading of Arogya Setu App on their smartphones or provide any other alternate such as self-declaration when demanded.

User undertakes that all bookings are subject to certain minimum medical wellbeing criteria specified by the Govt./appropriate authority from time to time. User should have no medical history of the COVID-19 virus 28 days before the date of scheduled travel, especially in case of inbound travel. In this regard, the User may be required to furnish medical proof or a health declaration in an applicable format.

VISA SERVICES

Role of BREAKBAG and Limitation of Liability

BREAKBAG acts solely as a facilitator for visa processing and is not responsible for the grant or rejection of a User’s visa in any manner whatsoever. The issuance of a visa is a decision solely taken by the concerned Embassy.

The services offered by BREAKBAG should not be considered or construed as visa advisory or consultancy in any manner. It acts solely on the instruction of the User. The User understands that they are solely responsible for understanding the requirements of a visa to undertake travel to the desired destination country/countries and then instructing BREAKBAG accordingly to initiate the visa application process.

BREAKBAG’s role is limited to informing the User about the documentary requirements for applying for a visa of a specific country or jurisdiction, collecting those documents as provided by the User, and submitting those documents to the respective embassy or high commission. The requirements for making a visa application (including, but not limited to, documentation, fees, and time frames) are provided by BREAKBAG based on the information provided by the respective embassy or high commission. BREAKBAG cannot and will not advise on the merit, completeness, or the suitability of the documents, or the likelihood of approval or rejection of the visa being applied for.

BREAKBAG may inform the User about the average time taken for the processing of a visa application by the respective embassy or high commission. However, it is the User’s responsibility to approach BREAKBAG for the application of a visa in a timely manner so as to secure a visa prior to the date of departure.

Each country has varying requirements for passports and visas. For instance, certain nations require a minimum number of blank pages in succession or a certain minimum balance period of validity of the passport. These requirements are established by those respective countries and are subject to change without notice. While BREAKBAG will make best efforts to ensure that its User(s) are given correct and updated information, there may be instances where the requisite information is not made available to BREAKBAG, as a result of which BREAKBAG may not be able to provide the same to its customers. In such cases, BREAKBAG will not be held responsible for any inaccuracy in such information.

The approval or rejection of a visa is at the sole discretion of the respective embassy or high commission to which the visa application is submitted. BREAKBAG has no role in either assessing or processing the visa application. Such approval or rejection depends on a lot of factors, such as the information provided by the User, current or previous nationality, place of application of visa, residence, gender, age, profession, recent travel, and religion.

The concerned consulate, embassy, or high commission may call the User for a face-to-face interview at its sole discretion. BREAKBAG has no role to play in this process. However, BREAKBAG will inform the User about the date, time, and any other requirements as communicated by the concerned Embassy or High Commission for the interview.

BREAKBAG may also appoint third-party vendors for the visa application process for different countries. Such third-party vendors will be responsible for applying for the visa of customers for the respective countries they have been appointed for.

For visa applications where submission of passports is required, BREAKBAG shall take all necessary steps to ensure that the passport is safely delivered to the User. However, BREAKBAG shall not be held liable if the passport is lost in transit or misplaced by the logistics service provider.

The countries for which the visa application services are being offered are mentioned in the visa section of the desktop site and the mobile app. The list of countries is subject to change at the discretion of BREAKBAG.

We are not liable for any delays or non-issuance of visas by consulates, embassies, or authorities.

CANCELLATION DUE TO VISA REJECTION

All travellers embarking on an outbound tour must possess a valid visa (including transit visas) to enter all countries they intend to visit or pass through.

If a user’s visa application is rejected by the relevant consulate, they must immediately inform BreakBag of the rejection. BreakBag will then deduct applicable cancellation charges and refund the balance amount (if any) in addition to any additional visa expenses incurred.

If the user wishes to reapply or appeal against the rejection of the visa, BreakBag will strictly follow the user’s instructions. The reapplication/appeal will be considered as a fresh transaction and the user will be responsible for paying any applicable fees associated with the reapplication/appeal process, along with a service fee to BreakBag. Unless requested by the user, BreakBag will not initiate any reapplication for the visa.

BREAKBAG COMPLIANCE

BreakBag is committed to ensuring compliance with all relevant regulations and laws, including those related to taxation and foreign exchange transactions. As such, we have established the following policies with regard to TCS and LRS compliance.

TCS on Overseas Tour Packages:

BreakBag defines an “Overseas tour package” as any tour package that includes expenses for travel, hotel stay, boarding, lodging, or any other expenditure of a similar nature, in relation to a visit to a country or countries or territory or territories outside India.

Under the provisions of Section 206C (1G)(b) of the Income Tax Act, 1961, users who book an Overseas tour package with BreakBag are liable to pay Tax collected at source (TCS) at an appropriate rate, over and above the price charged for the package. BreakBag will deposit the TCS amount collected with the government and issue the appropriate document/certificate to the user in compliance with this provision.

At the time of booking an overseas tour package, the user is required to provide a valid PAN for themselves and all travellers. BreakBag will validate the PAN provided by the user to check compliance with the provisions of Section 206CC of the Income Tax Act. If the PAN is found to be invalid or does not belong to the user/traveller(s), BreakBag has an obligation to cancel the booking in compliance with the law and process the refund as per the cancellation policy applicable to the booking.

BreakBag will also validate the PAN of the user/traveller(s) at the time of booking or at a later stage, in accordance with the provisions of Section 206CCA of the Income Tax Act. If the user qualifies as a “Specified person,” they will be required to pay TCS to BreakBag at a higher rate as may be applicable under section 206CCA. If the TCS collected at the time of booking falls short of the applicable rate of TCS, the user agrees to pay the additional TCS amount to BreakBag. If the user fails or disagrees to pay the additional TCS, BreakBag has the right to cancel the booking and process a refund as per the cancellation policy applicable to the booking.

Compliance of Liberalized Remittance Scheme (LRS):

The Reserve Bank of India mandates the collection of PAN details for all transactions made under the Liberalized Remittance Scheme (LRS), including any international bookings made on the BreakBag website or through sales channels. The user warrants and confirms that they will share PAN details for themselves and all travellers on or before the cut-off date prescribed by BreakBag, either at the time of booking or after the booking is made. If the traveller is a minor, BreakBag will require PAN details of the parent/guardian of the minor. Non-compliance with this requirement may result in the cancellation of the booking.

The user also warrants and confirms that the total amount of foreign exchange purchased or remitted during the current financial year, through all sources in India (including the current transaction), falls within the permissible limit prescribed by the RBI. If the limit gets breached before the actual remittance request is approved by the AD Bank, BreakBag has an obligation to cancel the booking in compliance with the law and process a refund as per the cancellation policy applicable to the booking. The user further confirms that any foreign exchange purchased by them for the purpose of international travel under the current booking will be utilized for the indicated purpose.

The user authorizes BreakBag to retrieve their/ traveller(s) PAN details from the user’s profile, previous bookings, or to share their/traveller’s data with third parties for collecting or verifying PAN details solely for the purposes mentioned in this agreement.

BreakBag does not collect a user’s PAN details without their consent.

USER RESPONSIBILITIES

BreakBag may require the User to pay a non-refundable interest-free booking fee at the time of booking the tour.

In the event that the User cancels the booking or fails to adhere to the tour payment schedule as informed in the documentation checklist or in the event that the visa of the destination country is not granted or the User is unable to travel on the tour booked due to any personal reason, including medical grounds or sickness, cancellation charges will apply as communicated to the User by BreakBag.

The User acknowledges that the booking of air tickets and hotels for a tour is done in parallel to visa processing to ensure availability as per the proposed itinerary. In the event of any denial or rejection of the visa, BreakBag shall be entitled to recover any cost incurred in making such bookings by way of deducting cancellation charges as specified hereinabove. The User acknowledges that such charges are just and fair and are deducted towards expenses that BreakBag incurs towards making bookings at the request of the User and consequent cancellation or non-travel by the User.

BreakBag advises all users to carefully review the description of services and products before making a booking. By making a booking, users agree to be bound by the terms and conditions outlined in the booking confirmation and the confirmed booking voucher. These terms and conditions should be read in conjunction with the User Agreement.

If a user makes a booking on behalf of another person, it is their responsibility to inform that person about the terms and conditions of this Agreement, including all applicable rules and restrictions.

Users must follow all procedures and guidelines, which may be modified from time to time, when using the services available through BreakBag. Users are also required to comply with all applicable laws, regulations, orders, directions, etc. issued by the Central Government, State Government, District Authorities, or any other statutory body empowered to do so regarding the use of services or for each transaction.

The services are provided on an “as is” and “as available” basis. BreakBag may change the features or functionality of the services being provided at any time, at its sole discretion, without prior notice. BreakBag expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, and fitness for a particular purpose. No advice or information, whether oral or written, obtained from BreakBag or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.

In the unlikely event that a booking made through BreakBag is not confirmed for any reason, BreakBag will process a refund of the amount paid by the user and inform the user accordingly. BreakBag is not obligated to provide an alternative booking or compensation in lieu of the unconfirmed booking. Any subsequent bookings will be treated as new transactions, and any applicable refunds will be processed in accordance with the policies of the service provider and BreakBag.

The user shall be solely responsible for all charges, fees, duties, taxes, and assessments that may arise from the use of the service, in compliance with applicable laws. Refunds for canceled bookings will be processed to the respective account or banking instrument (such as credit card, wallet, etc.) used for payment for that booking.

Bookings made by the user through BreakBag are subject to the applicable cancellation policy as stated on the booking page or communicated in writing to the customer.
